Pty Limited ACN 060 356 694 ("Reef Australia", “we” or “us”) operates the websites www.shop-reef.com.au and www.reef.com/au/ (each a "Website”) pursuant to agreements with South Cone Inc. ("Reef").  We recognize that you care how information about you is used and shared. We have created this Privacy Policy to inform you of our information collection, use and sharing practices. ONLINE COLLECTIONS

How we collect and use your personal information

Reef Australia respects your privacy. When you visit a Website, you may provide personal information to us. The information collected by us includes information that you give us when you, for example, make product purchases, request information or communications, register to join the website email lists, forums, blogs, etc., register for events, participate in promotions, enter contests or other marketing activities.  The information collected may include your name, address, city, state, telephone and email details.

We collect information about gift recipients (i.e., ship to addresses) to fulfil the gift purchase, respond to customer service inquiries and for analysis purposes only.  If at any time the functionality is available and you choose to use invitation tools or mobile services to invite or contact friends through a Website, we will ask you for information needed to send the invitation, such as your friends' email addresses, your email address, your Facebook account, other contact lists (e.g., Gmail, Twitter, Hotmail, and Yahoo) or your mobile phone and your friend's mobile phone.  If you provide us with the personal information of another person (e.g. for a gift) you warrant to us that you have permission to do so.

 

Use of Cookies

We may also collect website interaction information through the use of cookies.  A cookie is a small data file that certain websites write to your hard drive. A cookie file can contain information such as a user ID that the Website uses to track the pages you visit, but the only personal information a cookie can contain is information you supply yourself. We may disclose collected information to Reef and its affiliated entities to fulfil our obligations to them under our distribution arrangements or to third party contracted service providers who use that information only for purposes related to the conduct of our business. For example, a third party may handle our payment processing, shipping, data management, email distribution, market research, information analysis, and promotions management.  We may also share your information to administer a Website feature (e.g. video download or event registration) and in that case you will be given the option to opt out of the feature if you do not want your information shared.  We do not make individual identifying information available to third parties, including business partners, for marketing purposes without your consent to such sharing of information. 

We may disclose specific information when required by law, regulation or a government agency including law enforcement. We may share information to prevent illegal uses of the Website or violations of the terms of use, or to defend ourselves against third-party claims. We may also share information with companies assisting in fraud protection, counterfeiting or investigation.

How we collect and use your personal information

We collect personal information for our offline business activities such as wholesale and retail operations, interactions with suppliers, responding to general business enquiries, recruitment activities or resolving complaints.   This information is generally only contact information (name, address, email and telephone numbers) collected directly from you or someone you have permitted to provide it to us.  If the information is provided for recruitment purposes, we might collect more detailed information about you (e.g. your academic record, work history, background checks etc.) that is relevant for assessing your suitability for a position with us. If you do not provide the information required, we may not be able to respond or interact with you or, in the case of recruitment, to consider your application.  

If you are a contractor who perform services for us, we will collect information which might include name, address, e-mail address, skype address, job title, phone numbers, remuneration details, emergency contact details, memberships of professional organisations, financial and banking information, tax file number and so on.

We will only use the information provided for the purposes for which it was collected unless you have consented to us using, or would reasonably expect us to use, the information for a different purpose or as permitted by law. 

Your contact details, including email address, may be added to our mailing list and used for direct marketing purposes, in which case an opt-out statement and facility will be available or you can remove your name from our list by contacting us or sending us an email and asking to be removed from the mailing list.

 

When we disclose this information

Personal information collected for these purposes will only be disclosed to our personnel, contractors, suppliers, service providers, business partners, recruiters, referees or others as you would reasonably expect for the above (or related) purposes and only otherwise disclosed as required or permitted by law.  

 

Social Networking

If you communicate with us through a social networking service such as Twitter or Facebook, the social network provider and its partners may collect and hold your personal information and this may be overseas. This is not controlled by us and you should review the privacy policies of the providers.

 

How we hold personal information

We take reasonable steps to protect all information which we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. All personal information held electronically is kept on secure servers and protected by firewall security systems.  We may also hold some personal information in hard copy e.g. business cards.  Only personnel involved in our business have access to this information.

 

Overseas disclosures of information

If we share your information with Reef or its affiliated entities the information will be transferred overseas.  Reef operates in many countries but generally this information will be held in the USA or the European Union.  Please note that we have not taken steps to ensure that Reef and/or its affiliates do not breach the Australian Privacy Principles in relation to your information.  By using a Website and providing your personal information to Reef Australia, you consent to us disclosing your personal information to Reef and/or its affiliated entities.  If you do not consent to disclosure in these circumstances you must not use a Website or provide us with your personal information.
